Terms and conditions

These terms and conditions (the "Terms") are an agreement between you and Pixie Education Pty Ltd (ABN 58 692 683 720) ("we", "us" or "our"). They cover your use of Citizenship Test Australia, including our website at citizenshippracticetest.com.au and our mobile apps (together, the "App").

By using the App, you agree to these Terms. If you do not agree, please do not use the App. Please also read our Privacy Policy, which forms part of these Terms.

1. App store terms

If you download the App from an app store, the rules of that store also apply to you, in addition to these Terms.

Apple App Store

If you download the App from the Apple App Store:

  • These Terms are between you and Pixie Education Pty Ltd only, not with Apple. Apple is not responsible for the App or its content.
  • Your licence to use the App is also subject to Apple's standard Licensed Application End User License Agreement (the "Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Where these Terms and the Standard EULA differ on licensing, the Standard EULA applies.
  • We, not Apple, are solely responsible for the App and for any maintenance and support. Apple has no obligation to provide support for the App.
  • We, not Apple, are responsible for any claim that the App, or your use of it, fails to meet a legal requirement, infringes a third party's rights, or breaches consumer protection or similar laws.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Google Play

If you download the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App.

2. Who can use the App

You may use the App to study for the Australian citizenship test. To make a purchase, you must be able to enter into a legally binding contract. If you are under 18, please use the App with the involvement of a parent or guardian, and only a parent or guardian may make a purchase on your behalf.

3. What the App provides

The App offers:

  • Mock tests in the official format of 20 questions each
  • Chapter tests covering each part of Our Common Bond
  • A bank of practice questions with answers and explanations
  • Practice by topic and a review list for questions you miss (Premium)
  • Progress tracking, including score history and per-topic results

The practice questions are based on the official testing materials, Australian Citizenship: Our Common Bond. The App is a study aid only.

4. Accounts and sign-in

You can use the free features of the App without an account. To access Premium on the website, you sign in with a magic link sent to your email, or with Google sign-in. We do not use passwords. You are responsible for keeping access to your email account secure, since anyone with access to it could sign in as you.

5. Free and Premium features

Mock tests 1 to 4 and all chapter tests are free, and most of the App works offline. A one-time purchase of Premium unlocks mock tests 5 to 50, the full question bank, practice by topic, and the review list. We may change which features are free or Premium from time to time.

6. Payment and refunds

Premium is a one-time purchase, not a subscription. It does not renew automatically and there is no recurring charge. The price is shown to you before you pay.

Website purchases

Payments made on our website are processed by Stripe. We do not store your full card details. If you believe you have been charged in error, contact us at support@citizenshippracticetest.com.au.

App store purchases

In the iOS app, Premium is a one-time, non-consumable in-app purchase charged to your Apple ID at the time of purchase. In the Android app, Premium is a one-time purchase through Google Play. Because Premium is not a subscription, there is nothing to cancel. If you reinstall the App or move to a new device, you can restore your purchase using the restore option in the App.

Refunds

Refunds for purchases made through the Apple App Store or Google Play are handled by Apple or Google under their policies, and we are not able to action those refunds directly. For purchases made on our website, contact us and we will help. Nothing in these Terms limits any rights you may have under the Australian Consumer Law.

Access across platforms

A Premium purchase unlocks Premium on the platform where you bought it. At this time, a purchase made on the website may not automatically unlock Premium in the mobile apps, and the reverse may also apply. We are working towards linking purchases across platforms.

7. Intellectual property

The App and its content, including the practice questions, explanations, text, design, logos and software, are owned by Pixie Education Pty Ltd or its licensors, and are protected by intellectual property laws. Our Common Bond is published by the Australian Government and remains the property of its owners.

We grant you a personal, non-exclusive, non-transferable and revocable licence to use the App for your own study, subject to these Terms. You may not copy, resell, redistribute, reverse engineer, or create derivative works from the App or its content, or remove any notices of ownership.

8. Acceptable use

You agree not to:

  • Use the App in any way that breaks the law or infringes the rights of others
  • Try to gain unauthorised access to the App, our systems, or other accounts
  • Interfere with or disrupt the App or the networks it relies on
  • Use bots, scrapers or other automated tools to access or copy the App without our permission
  • Introduce viruses, malware or other harmful code

9. Third-party services

The App relies on third-party services such as Apple, Google and Stripe, and may link to other websites such as the Department of Home Affairs. We do not control these services and are not responsible for them. Your use of them is subject to their own terms.

10. Disclaimers

The App is provided on an "as is" and "as available" basis. To the extent permitted by law, we do not warrant that the App will be uninterrupted, error-free or secure, or that the content will always be accurate, complete or current. The App is a study aid and is not legal, migration or professional advice.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law and that cannot lawfully be excluded. Where we are permitted to limit our liability for a breach of such a guarantee, our liability is limited to resupplying the App or paying the cost of resupplying it.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or any loss of profits, data or goodwill, arising from your use of the App. Our total liability for all claims relating to the App will not exceed the greater of the amount you paid us in the twelve months before the claim, or A$100. Some of these limitations may not apply to you where the law does not allow them.

12. Indemnity

You agree to indemnify us against any claims, losses and reasonable costs arising from your use of the App, your breach of these Terms, or your breach of the rights of another party, except to the extent caused by us.

13. Changes to the App and these Terms

We may update, suspend or discontinue any part of the App at any time. We may also update these Terms from time to time. If we make material changes, we will update the date at the top of this page and, where appropriate, let you know in the App. Your continued use of the App after changes take effect means you accept the updated Terms.

14. Termination

We may suspend or end your access to the App if you breach these Terms or use the App unlawfully. You may stop using the App at any time. Sections that by their nature should continue, including those on intellectual property, disclaimers, liability and indemnity, will survive termination.

15. Governing law

These Terms are governed by the laws of the Commonwealth of Australia. You agree to the non-exclusive jurisdiction of the courts of Australia for any dispute relating to the App.

16. General

If any part of these Terms is found to be invalid or unenforceable, the rest will continue to apply. Our failure to enforce a right is not a waiver of that right. You may not transfer your rights under these Terms without our consent. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the App.
